These Terms govern your use of FloatPOS ("the Service"), provided by Unkink (Pty) Ltd (registration number [reg no]) ("we", "us"). By creating an account or using the Service, you ("you", "the Customer") agree to these Terms.
FloatPOS is a cloud-based point-of-sale and business-management application provided on a subscription basis. We may update, improve or modify features from time to time.
You must provide accurate information, keep your login credentials secure, and are responsible for activity under your account. You must be authorised to act for the business you register.
You agree not to misuse the Service, attempt to breach its security or tenant isolation, use it unlawfully, or use it to store or process data you are not entitled to.
As between you and us, your business data remains yours. We process it as your operator solely to provide the Service, in line with our Privacy Policy and Operator Agreement. You can export your data from within the app at any time. You are responsible for the lawfulness of the data you enter, including obtaining any necessary consents from your own customers and staff.
The Service is provided "as is" and "as available". While we work hard to keep it accurate and reliable, we do not warrant that it will be uninterrupted or error-free, and it is not a substitute for professional accounting, tax or legal advice. You are responsible for verifying your own financial, tax and compliance records.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue or data. Our total aggregate liability arising from or relating to the Service is limited to the subscription fees you paid in the [three (3)] months preceding the event giving rise to the claim. You agree to indemnify us against claims arising from your unlawful use of the Service or from data you enter in breach of these Terms or applicable law. [Confirm scope with counsel.]
You may cancel at any time. We may suspend or terminate access for non-payment or material breach, giving reasonable notice where practicable. On termination you may export your data for a reasonable period, after which it may be deleted.
We may amend these Terms. Material changes will be notified in-app or by email, and continued use after the effective date constitutes acceptance. The version date above will change.
These Terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of its courts.
